trainscafe is an e-catering service provider company

By ordering any product or Services from this Website or its phone applications or through our call center number displayed on this website, you agree to be bound by these Terms and Conditions. Moreover, our Services are very diverse, therefore, sometimes additional terms or service requirements may apply for some services. Any such additional terms will be available with the relevant Services, and those additional terms become part of your agreement with us if you use those Services.

1. DEFINITIONS 

A. We are trainscafe, a brand of trainscafe Web Services Private Limited, a company registered under the Indian Companies Act unless otherwise stated. ’Agreement’ is a reference to these Terms and Conditions, the Privacy Policy, any order form and payment instructions provided to you;

B. ‘Website’ is a reference to our Website http://trainscafe.com on which we offer our Product or Services.

C. ‘Service’ or ‘Services’ is a reference to any service which we may supply and which you may request via our Website.

D. ‘Restaurant’, ‘Outlet’ or ‘Outlets’ are restaurant and restaurant owners who prepare and/or deliver the Product or Services ordered on this website.

E. ‘Privacy Policy’ means the policy displayed on our Website that details how we collect and store your data;

F. ‘Customer’, ‘you’, ‘your’, ‘yours’, ‘users’ are references to you the person accessing this Website and ordering any Product or Services from the Website or any other channel provided by trainscafe

G. ‘we’, ‘us’, ‘our’, and ‘trainscafe’ are references to the Company;

H. ‘Product’ is a reference to any goods which we may offer for sale from our Website from time to time.

I. ‘Food Delivery’ is a reference to perishable goods and to any form of delivery service, which both are provided by Restaurants chosen for delivery.



 2. ORDER BOOKING AND PROCESSING  


A. All orders booked on this website or through its call center number are a contract for the supply of Food Delivery between you and the Restaurant.

B. Customers are requested to check all the information and details they are filling in while booking the orders. Please note it is the customer’s responsibility to check the information that they have entered, and correct any errors before clicking on the "Book Order" button since once a customer clicks on this, an order ID is created and input errors cannot be corrected.

C. If at any time before you click on the "Book Order" button, you decide that you do not wish to proceed with your order, you should close the application window.

D. In case a customer selects ‘Cash on Delivery (COD) before clicking on the "Book Order" button, trainscafe will begin processing your order and we will send you a notification by SMS that your order is being processed. For online payment orders, on receipt of your payment, trainscafe will begin processing your order and we will send you a notification by SMS and email that payment has been received and that your order is being processed. SMS and an email confirmation will be produced automatically so that you have confirmation of your order details. You must inform us immediately if any details are incorrect. The fact that you receive an automatic confirmation does not necessarily mean that either we or the Delivery Restaurant will be able to fill your order.

E. In the case of online payment, if any payment you make is not authorized you will be returned to the previous page on the Website and we shall not be obliged to provide the services.

F. Please note that once you have made your order and your payment has been authorized you will be able to cancel your order according to the details mentioned in our cancellation policy.

G. Please note that from time to time there may be delays with processing payments and transactions, on occasion this can take up to 6 hours to be deducted from your bank account.


 3. DELIVERY  


A. Delivering the food items ordered on this website is the sole responsibility of the restaurant in the stipulated time with proper packing and hygiene.

B. We try our best to coordinate the delivery of the orders with the restaurants, but if in an unfortunate situation the said delivery fails, then we request the customers to get in touch with us immediately, and we will try to arrange the delivery at the next available upcoming station. Moreover, we too take a very close watch at all the deliveries, and ourselves arrange for deliveries at upcoming stations, but it becomes very helpful when customers themselves notify us of any such occurrence.

C. In the event of customer’s unavailability to accept the order at the time of delivery, or if the customer is unavailable at the mentioned coach and seat number, or if you are unable to communicate to us your updated coach and seat number (only in case of W/L or RAC situations), then such orders shall be deemed to have been delivered to you and all risk and responsibility about such deliveries shall pass on to you. Any costs which we incur as a result of the inability to deliver shall be your responsibility of the customer and therefore shall indemnify us in full for such cost.

D. Restaurants delivering the orders will aim to deliver the exact order placed by you within the stoppage time at that particular station chosen by you.

E. Restaurants and we shall not be liable to you for any losses, liabilities, costs, damages, charges, or expenses arising out of late delivery.


 4. GENERAL TERMS FOR OFFERS AND PROMOTIONS  


A. Discounts will be applied to the total merchandise value including VAT and applicable taxes. Issuance or redemption of a voucher or coupon will apply to the total value of the qualifying order once all promotional discounts have been applied. Final charges after applying coupons and vouchers will be inclusive of Food charges and as well as customization charges. The discount may not be applicable on Delivering costs.

B. Only one credit note/gift coupon/coupon can be used per order unless otherwise stated.

# Discount coupons - Discount coupons may from time to time be offered to account holders; such coupons may only be applied to orders made through the account to which the discount coupon was offered and registered. If you need a refund, this will be made in the same way as the original payment method (such as onto a gift voucher, debit/credit card account, a combination of the two, and in the case of COD, a cheque).

# Promotional discount coupons - We may from time to time offer promotional discount coupons which may apply in respect of any, or certain specified, Orders made through this Website.

C. www.trainscafe.com shall introduce various offers, schemes, or contests at different times. The terms and conditions for such Contest shall be separately available on the Site.

D. www.trainscafe.com reserves, the right to change/modify/add/delete any of the terms and conditions prevailing on the different promotional schemes it introduces in the market from time to time. www.trainscafe.com, at its discretion, can withdraw a particular scheme from the website or market.

E. In case of any query of use of coupon and/or credit note or regarding the schemes, please email customer care at INPUT EMAIL ID HERE.

F. While participating in any www.trainscafe.com a contest you hereby agree to release and hold trainscafe (and its officers, directors, agents, subsidiaries, affiliates, joint ventures, and employees) harmless from any claim or demand, but not limited to reasonable attorneys' fees, or arising out of or related to your participation in the said Contest.

 5. CANCELLATION PROCESS 


You can cancel your order up to the order cut-off time. You can cancel your order by either calling our call center number or through our website. You will need to quote the mobile phone number and order ID to cancel the order. You may be required to log in on the website to cancel your order, where applicable. We will not be able to cancel any order after the order cut-off time, which is usually one hour before the STA of the train at the delivery station.

If the cancellation is made up to 24 hours before the cut-off time, and you have paid in advance online, we will refund or re-credit your debit or credit card with the full amount less a 10% cancellation administrative fee within 14 days.

If the cancellation is made between 24 hours and order cut-off time, and you have paid in advance online, we will refund or re-credit your debit or credit card with the full amount less a 25% cancellation administrative fee within 14 days.

In the unlikely event that the Delivery Restaurant delivers a wrong item, you have the right to reject the delivery of the wrong item and you shall be fully refunded for the missing item. If the Delivery Restaurant can only do a partial delivery (a few items might be not available), its staff should inform you or propose a replacement for missing items. You have the right to refuse a partial order before delivery and get a refund. We will put our best effort into ensuring that the delivery is complete and as per your order, however, this may not be possible in all cases.


 6. HOW TO MAKE AN ORDER AND HOW IT IS PROCESSED 


A. Any contract for the supply of Food Delivery from this Website is between you and the Delivery Restaurant.

B. Once you have selected your order from the menu on the website you will be allowed to submit your order by clicking on the "Finish" button. Please note it is important that you check the information that you enter and correct any errors before clicking on the "Finish" button since once you click on this input errors cannot be corrected.

C. If at any time before you click on the "Finish" button, you decide that you do not wish to proceed with your order, you should close the application window.

D. Upon clicking on the "Finish" button, in case you have selected Cash on Delivery (COD) payment trainscafe will begin processing your order and we will send you a notification by SMS that your order is being processed. For online payment orders, on receipt of your payment, trainscafe will begin processing your order and we will send you a notification by SMS and email that payment has been received and that your order is being processed. SMS and an email confirmation will be produced automatically so that you have confirmation of your order details subject to the network connectivity. You must inform us immediately if any details are incorrect. The fact that you receive an automatic confirmation does not necessarily mean that either we or the Delivery Restaurant will be able to fill your order.

E. In case of online payment, if any payment you make is not authorized you will be returned to the previous page on the Website and we shall not be obliged to provide the services. We shall not be responsible for any payment issues owing to bank or mobile network

F. Please note that once you have made your order and your payment has been authorized you will be able to cancel your order according to the details in paragraph 5


 7. DISCLAIMER 


A. While trainscafe tries to ensure that information on this Website is correct, we do not commit its accuracy. trainscafe may make changes to the material on this Website, or to the services and prices described in it, at any time without notice. The material on this Website may be out of date, and trainscafe does not commit to updating that material. In particular, we do not promise and confirm that the information provided by the Delivery Restaurants and displayed on this Website such as the menus and pricing is correct or up to date

B. trainscafe provides you with access to this Website and our services on the basis that, to the maximum extent permitted by law, we exclude all representations, warranties, conditions, and other terms (including any conditions implied by law which but for these Websites Terms might apply concerning this Website and the services that we provide).

C. The products supplied by us are provided for private domestic and consumer use only. Accordingly, we do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss or damage to property, and/or loss from claims of third parties arising out of the use of the Website or for any products or services purchased through us.

D. We have taken all reasonable steps to prevent Internet fraud and ensure any data collected from you is stored as securely and safely as possible. However, we cannot be held liable in the extremely unlikely event of a breach in our secure computer servers or those of third parties.

E. You are responsible for the security of the password that you used to register with this Website. Unless trainscafe negligently discloses your password to a third party, trainscafe will not be liable for any unauthorized transaction entered into using your name and password.


 8. LIABILITY 


trainscafe and any of our group companies and the officers, directors, employees, shareholders, or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, or loss or damages arising from or connected in any way to business interruption, loss of opportunity, loss of anticipated savings, wasted management or office time and whether in tort (including negligence), contract or otherwise, even if foreseeable) in connection with our services, this Website or in connection with the use, inability to use or the results of the use of this Website, any websites linked to this Website or the material on these websites.

trainscafe's customer care team will, subject to your compliance with these Website Terms and cooperation, use all reasonable endeavors to resolve any issues arising from the submission of orders via this Website including the processing of all credit or debit card refunds and chargebacks where appropriate. However, please note that the legal contract for the supply and purchase of food and beverages is between you and the Restaurants that you place your order with. trainscafe cannot give any undertaking that the food and beverages ordered from the Delivery Restaurants through this Website will be of satisfactory quality and any such warranties are disclaimed by Gofoodieonline. The delivery Vendor restaurants, its management, and /or employees are only responsible for the quality of food and other issues related to food delivery. These disclaimers do not affect your statutory rights against the Delivery Restaurants.

Nothing in these Website Terms excludes or limits our liability for death or personal injury arising from trainscafe's negligence, nor trainscafe's liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited under applicable law. Nothing in these Website Terms affects your statutory rights

except for any liability referred to in paragraph (L)3 above, trainscafe's total liability to you concerning your use of the Website and the services that we provide including (but not limited) to liability for breach of these Website Terms and tort (including but not limited to negligence) is limited to an amount equivalent to trice the value of your order or three thousand Indian rupees, whichever is the lower.

If your use of material on this Website results in the need for servicing, repair, or correction of equipment, software, or data, you assume all associated costs.

trainscafe.com is not liable to you for any damage or alteration to your equipment including but not limited to computer equipment, handheld device, or mobile telephones as a result of the installation or use of the Application
